Welcome to Magically Me, a mobile application ("App") owned and operated by Reclamation Ventures ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the Magically Me App. By downloading, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By using the Magically Me App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

2. App Description

Magically Me is a digital app designed for children. The primary purpose of the App is to educate users on how to perform stage magic tricks.

3. User Accounts

3.1. To use the features of the App, you required to create an account. When registering for an account, you must provide accurate and complete information.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3. We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading.

4. Privacy and Data Protection

4.1. We are committed to protecting the privacy of children who use our App. Our collection, use, and disclosure of personal information from children under the age of 13 are governed by our Privacy Policy.

4.2. We collect the following personal information from children using our App:

  • Name

  • Email address

4.3. The collected personal information is used solely for creating and managing the child's account.

4.4. We do not disclose personal information collected from children to any third parties.

5. Parental Rights and Consent

5.1. Parents have the right to review their child's personal information, direct us to delete it, and refuse to allow any further collection or use of the child's information.

5.3. We will not require a child to disclose more information than is reasonably necessary to participate in the App's activities.

6. Intellectual Property

6.1. All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Reclamation Ventures or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as incidental to normal use of the App.

7. Prohibited Uses

You agree not to use the App:

  • In any way that violates any applicable federal, state, local, or international law or regulation

  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation

  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity

  • In any way that could disable, overburden, damage, or impair the App or interfere with any other party's use of the App

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9. Limitation of Liability

IN NO EVENT WILL WE BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE APP OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.

11. Governing Law and Jurisdiction

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
